Summary

Despite being a country that enjoys considerable freedom of expression in Asia and among a small number of countries in the region that provide statutory guarantee of access to government information, Thailand still treats defamation as a criminal offence. Offenders can be sued for criminal and/or civil cases for a defamatory act. Criminal lawsuits are to seek imprisonment for the offenders while civil lawsuits are to seek monetary or any other kind of compensations. Thailand is a civil law system. Its fundamental law is included in the four main codes, namely, the Penal Code, the Civil and Commercial Code, the Criminal Procedure Code, and the Civil Procedure Code. Course syllabuses for undergraduate law students in universities mainly deal with provisions in these four codes.
