Summary
The civil court system in Malaysia is divided into the subordinate courts and the superior courts. Briefly, the Superior Courts consist of the appellate courts (Federal Court, the Court of Appeal) and the High Court while the subordinate courts consists of the Sessions Court and the Magistrates Court. The courts are separated by mainly monetary jurisdiction of the courts wherein the High Court has an unlimited jurisdiction to hear all civil claims. The Federal Court is the highest court in Malaysia. The Federal Court may hear appeals of civil decisions of the Court of Appeal only if the Federal Court grants leave to do so. Malaysia, like many commonwealth nations, adopts a common law system. As such, decisions from commonwealth jurisdictions such the United Kingdom, Australia, India and Singapore can be used as “persuasive authorities.”
