Due Process

Summary

Due process affords benefits for both parties to a dispute. It is a means for accurate gathering and verification of facts and provides a measure of fairness to the resolution of a dispute. The basic requirements are reasonable notice and an opportunity to be heard by an unbiased decision maker. It is required where state action is involved or where statutes or contracts call for its use. It is desirable even where not legally necessary.
